Forensic Psychological & Neuropsychological Assessment
Legal matters often require more than a clinical opinion. They require clear, objective, well-supported information that can help attorneys, courts, agencies, employers, and families understand a person’s cognitive, emotional, behavioral, and functional abilities.
At Elements Psychological Services, we provide forensic psychological and neuropsychological evaluations for a range of civil, educational, disability, workplace, and capacity-related matters. Our approach is thorough, evidence-based, and tailored to the specific referral question.
Neuropsychological Expertise for Legal Questions
As clinical neuropsychologists, we specialize in understanding the relationship between the brain and behavior. Our evaluations examine how cognitive, emotional, psychiatric, neurological, and medical conditions affect an individual’s functioning in everyday life—and how those findings relate to the legal questions at hand.
Each evaluation is individualized and may include a comprehensive clinical interview, record review, collateral interviews, standardized neuropsychological and psychological testing, symptom and performance validity measures, behavioral observations, and a detailed written forensic report.
Areas of Forensic Evaluation
Educational & School-Based Matters
Educational and forensic evaluations may be requested in cases involving special education disputes, Independent Educational Evaluations (IEEs), learning disabilities, ADHD, autism spectrum disorder, executive functioning difficulties, emotional disabilities, school refusal, and questions regarding appropriate educational programming or accommodations.
Our evaluations provide objective data to help clarify diagnoses, identify educational needs, and inform recommendations for schools, attorneys, and families.
Decisional Capacity & Guardianship Evaluations
Questions about an individual’s ability to make informed decisions may arise following neurological illness, traumatic brain injury, dementia, developmental disability, serious mental illness, or other medical conditions. Capacity evaluations help determine whether an individual possesses the cognitive and functional abilities necessary to make specific decisions while preserving as much independence as possible.
These evaluations may address an individual’s capacity to:
- Make medical treatment decisions
- Manage finances and property
- Execute legal documents
- Live independently and safely
- Understand and appreciate the consequences of important decisions
- Consent to treatment or other services
When broader concerns exist regarding an individual’s ability to manage personal, financial, medical, or legal affairs, a guardianship evaluation may be requested by the court or legal counsel. These comprehensive evaluations assess cognitive functioning, judgment, reasoning, adaptive functioning, and overall decision-making capacity while recognizing that guardianship represents one of the most significant legal limitations on personal autonomy. Whenever appropriate, recommendations emphasize the least restrictive alternatives that maximize both safety and independence.
Independent Medical Evaluations (IMEs)
Independent Medical Evaluations provide objective opinions regarding cognitive, psychological, emotional, or behavioral functioning in the context of legal, disability, employment, or medical matters. These evaluations are independent and focused on answering specific referral questions rather than providing treatment.
Evaluations may address diagnostic clarification, causation, functional limitations, treatment needs, prognosis, and the consistency of reported symptoms with objective findings and available records.
Workers’ Compensation
Neuropsychological evaluations may be requested following workplace injuries or occupational illnesses that affect cognitive, emotional, or psychological functioning. We evaluate the impact of injury on attention, memory, executive functioning, emotional health, and overall work capacity.
These evaluations may assist in determining functional impairment, return-to-work recommendations, treatment planning, and the relationship between reported symptoms and occupational functioning.
Disability Evaluations
We provide comprehensive evaluations for short-term disability, long-term disability, and other disability-related claims involving neurological, psychiatric, cognitive, or psychological conditions.
These evaluations objectively assess diagnosis, severity of impairment, functional limitations, work capacity, and how symptoms affect activities of daily living and occupational performance.
